Teva has won a patent trial against Opiant Pharmaceuticals and Emergent Biosolutions for Narcan Nasal Spray, the only FDA-approved drug to treat narcotic painkillers (opiates).
Spray Narcan sales totaled $ 72 million in the first quarter of 2020. According to Emergent, which markets it, its sales were expected to reach $ 315-285 million by 2020.
A federal judge in New Jersey accepted Teva's claim that four patents protecting the drug by 2035 should not have been registered in the first place. Teva has received approval from the US Food and Drug Administration (FDA) to market the Narcan spray in April 2019, but so far it has not yet marketed it due to the patent lawsuit being conducted. Teva may delay the marketing date until a decision on the decision is made, which will most likely be filed by Opiant and Emergent.
The spray is based on the Naloxone molecule, which should form the basis of Teva's settlement agreement with thousands of lawsuits filed against her for allegedly engaging in the aggressive marketing of narcotic analgesics. As part of a principled agreement, signed in October 2019 between Teva, Johnson & Johnson and three drug distribution giants and four general prosecutors, Teva agreed to pay $ 250 million over a 10-year period and provide $ 23 billion worth of Naloxone tablets at no cost.
