Regional Labor Court will be asked to order Sunny Communication to employees unionize

The Histadrut applied to the Bat Yam Regional Labor Court, requesting to be part of a collective dispute hearing against Sunny Cellular Communications, alleging an ongoing violation of the company's management of workers' organization in general, and the chairman of the committee in particular. According to Dean Pelephone, the Histadrut wants to oblige the company to pay compensation without proof of damage of NIS 1.35 million.
The crisis at Sunny Communications, the official importer of Samsung products in Israel, has been going on for months, due to the company's management's refusal to come to terms with its employees' right to unionize. The discussions on signing a collective bargaining agreement are not progressing due to management dragging, along with its ongoing disdain for employee representation and attempts to thwart their incorporation.
A few months ago, a labor dispute was announced in the company, but the Histadrut has suspended the organizational steps, following a hearing in the Labor Court last month. This, as a constructive step, in the face of the parties' consent to negotiate, is mediated by the Commissioner for Labor Relations in the Ministry of Labor and Social Affairs.
Despite the company's agreement to negotiate, this continued to drag on this issue, canceled meetings with representatives of the Histadrut and the committee on a regular basis, refused to provide essential information for the negotiations, and in fact, worried about its failure.
Furthermore, the Company's management is taking steps aimed at hurting the salary and status of the Chairman of the Workers' Committee, Tal Sheetrit. The Chairman of the Board has become "Persona Non Greta" and is expelled from the Company's branches whenever he wishes to speak to employees of the Company's branches, as he is legally entitled to do.
The management even initiates scheduled reprimands with committee members, setting excessive targets and exerting a set of pressures and threats against them. It takes a harsh and degrading and public demeanor towards the members of the committee, and forcibly and violently removes them from the branches and corporate headquarters.
The Histadrut's application to the tribunal this morning reads, inter alia: "The Histadrut has discovered that the company does not cease from harsh and systematic acts aimed at harming the organization, especially the leaders of the organization."
The Histadrut requests the court to obtain an order instructing Sunny Communications to continue to conduct collective bargaining, in good faith, while revealing the information required for its management and holding regular meetings with the Histadrut and the workers' committee, pending the conclusion of a special collective agreement. The Histadrut also seeks an order prohibiting Sonny from harming the employees of the company leaders, including, in particular, the chairman of the workers 'committee, Tal Sheetrit, and prohibiting it from removing members of the workers' committee from the company's facilities.
In the Histadrut, the Tribunal is requesting that Sunny, pursuant to the provisions of the Collective Agreements Law, pay compensation for example compensation, without proof of damage in the total amount of NIS 1.35 million.
Chairman of the Cellular, Internet and High Tech Workers Union, Yaki Pioneers, said: "Sunny-Samsung may not be so bizarre to its employees. The company has tried and tried in an unfit way to break its workers' organization. That will improve working condition
