Economic Committee to Debate Bill Prohibiting Price Increases During Wartim

The battle against price hikes in the food industry is set to take center stage once again as a bill is brought before the Economic Committee on Wednesday. Competition Commissioner Adv. Michal Cohen has recommended to Economy Minister Nir Barkat that legislative action be taken to address the issue. Barkat, heeding this advice, has opted for a memorandum of law to freeze prices during times of war, rather than relying on recommendations to the association of marketing chains.

Tomorrow, the Economic Committee will vote on a preliminary reading of the proposed bill titled the Consumer Protection Bill (Amendment - Prevention of Exercising Unfair Influence During the Declaration of a State of Emergency), 2024-2024. This bill, put forward by MK David Bitan and others, aims to prohibit price increases during wartime in a significant and exceptional manner. The proposal comes after opposition from Finance Minister Bezalel Smotrich and the Ministry of Finance, who had initially opposed Barkat's direction.

Under the proposed legislation, price increases will be checked against the average price during the three-month period before the declaration of a state of emergency. Exceptions will be made for businesses able to demonstrate increased costs or those who have legally signed contracts with consumers. However, the bill may undergo amendments during committee deliberations.

The impetus behind the bill stems from the failure of marketing chains to unite with suppliers and freeze price increases voluntarily. Despite Barkat's initiative, no such agreement materialized, prompting the Competition Authority to express reservations and advocate for legislative intervention.

The Competition Authority has emphasized the absence of requests from marketing chains for permits to form binding agreements to block supplier price increases. Concerns have been raised regarding the potential for monopolistic practices and the adverse impact on consumers, including potential price increases and product shortages.

Furthermore, there are apprehensions regarding the impact on smaller suppliers and the unintended consequences of signaling price increases to the entire market. The proposed bill seeks to address these concerns and provide regulatory oversight to ensure fair pricing practices during times of crisis.

As the Economic Committee prepares to debate the bill, stakeholders await the outcome of this legislative effort to safeguard consumer interests in the face of economic uncertainty.
