Tel Aviv District Court rejected the petitions of Cellcom, Golan Telecom and Exphon against the fifth generation tender.
In the court ruling, the Tenders Committee considered that, in the circumstances, the model chosen was the best model for the purpose of submitting the tender. The committee's decision regarding the format of the tender procedure was adopted after professional and in-depth work. The model chosen is the best for achieving the purpose of efficient frequency allocation and promoting the communications market. "
The court also held that "the Tender Committee's decision on the tender model is at the heart of its professional judgment and that it was adopted following a thorough and comprehensive procedure, following professional teamwork and on the basis of expert advice in the field."
The petitioners will bear the respondent's expenses and attorney's fees of NIS 150,000.
The fifth-generation mobile auction was and is still the Ministry of Communications' hope to reduce gaps between Israel and the cellular market.
