The Central District Court approved the filing of a class action lawsuit against Leumi Card (now Max). The lawsuit concerns customers who have a Leumi Card credit card (associated with the Shufersal Club), who were granted a credit card fee exemption benefit for one year at the time of joining, when the plaintiff, at the end of the Leumi Card exemption period, began charging the fee without prior notice to customers. Judge Yehezkel Keener ruled that "the banking rules stipulate that despite the date of termination of the benefit in the agreement, the banking corporation is obliged to send the customer the prior notice. The assumption is, therefore, that the customer does not remember the date of termination of the benefit."
The ruling states that the members of the represented group are: "Leumi Card customers with credit cards of the Shufersal and Yesh clubs, who were not given prior notice of the end of the card fee benefit as required by law, in the period beginning on April 1, 2015 until the date Final judgment in the lawsuit.
Attorneys Ben Simon and Dalyot, representing the plaintiff, stated: “This is a lawsuit that deals with an important and significant consumer issue that is relevant to almost every person in Israel; Credit card companies offer new morning lures in which they offer to receive a seemingly free credit card without a significant card fee; But 'forget' to stand trial and update customers before the end of the benefit and the beginning of the collection of card fees. In this way, they pocket significant fees, without the customers being aware of it and without the customers being able to finance their steps, including choosing to give up the card or apply for a new benefit and / or switch to competing credit card companies, etc. Max said that "the company is studying the decision and will respond in court."
