Difficulties in real estate construction hinder the ability to maintain business as usual

Posted on Mar 18, 2020 by Ifi Reporter - Dan Bielski

While the construction industry has been deviated from the manpower reduction directive and has been defined as an essential sector for the economy, in an attempt not to hurt construction starts and cause a severe rise in housing prices, there are significant difficulties in the area that hinder the ability to maintain business as usual.
Although Palestinian workers have been allowed to stay in Israel and the construction sites can work in their own right, following the instructions of the Ministry of Health, local committees and engineering and licensing departments in the local authorities have significantly reduced manpower. These are the bodies that are responsible for making decisions and issuing permits and permits for construction. Therefore, the production of permits and discussions on project motions committees do not take place in their own right.
In addition, material questions about the nature of the planning committees' activities have not been decided and are dependent on the issuance of emergency regulations, which are only now being worked in the planning administration alongside the government ministries and professional bodies. For example, the decision whether an online hearing by an appeal committee or a local and district committee is legally valid - has not yet been made legally clear in the Planning Administration and the Justice Department. Hence, critical decisions to promote projects are stuck in the local authorities.
Yes, many projects waiting for permits and permits to begin construction are currently stuck, given the limited and limited activity of local committees and permit producers and issuers of permits in some municipalities.
"A crisis situation is currently underway where no local committee or local authority has the legal authority under emergency regulations to extend schedules," explains Anat Biran, a real estate and planning attorney. "For example, I have a client who needs to get a change permit for a project that is already underway, and for that he needs more permission from the Ministry of Health. However, in the Ministry of Health all officials are fully engaged in the Corona crisis, and no one is talking to him. The permits required and took all steps - but it depends on other authorities that have reduced their activities.
On the other hand, from the authority's point of view, it did not meet the deadlines - and construction was going to be delayed and rising. If there is no provision in the law that can be granted even if certain authorities or permits are missing, the construction industry will be stuck. There will be a snowball here if there are no quick adjustments. Excluding the construction industry without addressing all the committees and the bureaucratic system around the industry - will not help. "
