The fines were imposed after being convicted of serious environmental offenses and public harm. The sentencing was granted following administrative enforcement by the Northern District Office of the Ministry of Environmental Protection, due to landfill management in violation of business conditions and environmental hazards. In the following years, the defendants continued to violate the terms of the business license, and in 2012 on a tour conducted by representatives of the Ministry of the Environment at the site revealed that an unreasonable odor and visible debris that attracts animals, which can transmit contaminants and diseases. Additional patrols in 2014 found additional deficiencies, including bad smells, probably caused by decayed organic waste, and vast areas without cover. Tours in 2015 saw similar deficiencies, including a smell that made the nausea go to the representative of the Ministry of Environmental Protection who visited the place.
The Ministry of Environmental Protection argued in the hearing that the defendants committed the offenses over a period of several years, and that the public interest requires a strict and appropriate punishment, which will lead to both the individual deterrence and the deterrence of many. The infections were actually proven, causing a strong and improbable odor to the public while contaminating the stream and groundwater.

The landfill site located on Kibbutz Evron is only 600 meters away, and has provided services to one million residents in the Western Galilee. The landfill was operational by 2015. A new landfill was opened in 2016. Only after the landfill was closed was an indictment filed.
