The Jerusalem District Court, sitting as an administrative court, rejected Tadbik's petition against the Ministry of Environmental Protection for a financial sanction imposed on it by the ministry.
The Ministry of Environmental Protection imposed a financial sanction of NIS 2,200,560 on Tadbik for three serious violations: deviation of the TOC (volatile organic compounds) emission from the chimney; Non-reporting of chimney sampling that exceeded; And the non-functioning of the control and warning system in the factory belonging to the company, which is located in the Teradion industrial area in Misgav in the center of the Galilee.
The company petitioned against the ministry, arguing that the emission permit granted to it did not apply to the coal chimney that was built after the permit was issued and its activities resulted from the financial sanctions. In addition, the company claimed that there was no need to impose three separate sanctions and that the amount of the sanction was disproportionate to the severity of the violations.
Judge Anat Singer rejected the petition and ruled that the full claims of the Ministry of Environmental Protection should be accepted. According to the ruling, Tadbik was ordered to pay the full amount of the sanction imposed on it by the ministry, about NIS 2.2 million, and in addition it will be required to pay reimbursement of expenses in the amount of NIS 20,000. This, after the company did not meet the payment of the sanction and exceeded its payment on time.
Judge Singer stressed the seriousness of the violations, saying that "the health risks of exposure to volatile organic compounds should be mentioned. And he has the professionalism to exercise his discretion and impose sanctions that will prevent the damage. "
In summary, the court emphasized that while the Ministry of Environmental Protection was prepared, in the context of the hearing of the petition, to positively consider the payment schedule in accordance with the reduction regulations, Tadbik refused.
The petition was handled by attorney Yoel Vogelman of the Jerusalem District Attorney's Office, accompanied by attorney Shnez Mula-Harbji, legal counsel for the Northern District of the Ministry of Environmental Protection.
The ministry will continue to monitor the activity of the plant, and will not allow any violation or harm to public health and the environment.
