The Justice court postponed the method of payment for workers' isolation days
Posted on Oct 1, 2020 by Ifi Reporter
The High Court this evening (Thursday) approved a one-month postponement, until October 28, 2020, in order to allow the necessary legislation for the outline agreed yesterday between the Ministry of Finance, the Histadrut and the employers 'presidency, regarding the method of payment for workers' isolation days. Does not allow other organizations to join the petition. Meanwhile, the Histadrut joins the demand of many employers' organizations and non-profit organizations working for the annulment of the controversial agreement.
It was also announced tonight that a committee in the Knesset will hold a discussion on the issue immediately after the Sukkot holiday. The chairman of the subcommittee for small and medium-sized businesses, MK Keren Barak, submitted a bill that will form a line for both employers and employees, according to which businesses will be reimbursed by the National Insurance Institute for sick pay paid on isolation days.
The arrangement extends the sick days of workers in Israel, "the Histadrut wrote in a letter to Finance Minister Israel Katz, made through attorneys Paz Mozer and Bar Laudon of the Lieblich Mozer Glick firm.
The new agreement reached stipulates, among other things, that the days of isolation have been reduced from the employee's sick days quota, when the payment for the days will be, as stipulated by law. The employee will bear the cost of the first two days and the state and employers will divide the cost of the remaining days so that at the end of the day the total cost will be divided between the employee, the state and the employer.
The High Court demanded that a proposal be submitted to it to finance the isolation days until September 30. In order to complete the procedure for enacting the agreements, the parties applied to the High Court to extend the existing arrangement for another month.
Appealing to the Minister of Finance reveals that the arrangement established contains a series of violations and deprivation of rights from the workers who are harmed by the move. For example, two paid days will be deducted at the expense of the employees and the rest will be deducted from the total number of sick days. "This is delusional and offensive because in the moment of truth when they seek to exercise the sick days granted as a basic right in an enlightened state, they will not be left with the option of having the days and will be left without pay at all," the appeal argued.
The chairman of the Histadrut, Yoav Simchi, appealed to the Minister of Finance and demanded "cancel the arrangement and not send hands on the workers' sick days."
As mentioned, the agreement provoked a great deal of opposition among, among others, the independent organizations, the association of the retail, fashion and catering chains and the presidency of the business sector, headed by Dubi Amitai. In an interview with the Ynet studio, Amitai said today that "this is a shameful agreement, a bad agreement. It is an exercise that bypasses the High Court."
