Israir has petitioned the High Court of Justice against the limits not to allow buying flight tickets

Israir has petitioned the High Court of Justice against regulations, according to which only those who purchased a plane ticket by Friday, September 25, will be able to fly from Israel during the closure period. According to them, the direct damage caused to them as a result of the directive amounts to more than $ 2 million.
Israir claims, among other things, that the decision is contrary to the Basic Law: Human Dignity and Liberty, according to which every person is free to leave Israel. The petition - filed through attorneys Roy Belcher and Guy Zeevi of Crispin, Rubinstein, Belcher & Co. - claims that the ban is inconsistent with the temporary provisions of the Law on Special Authorities to Deal with the New Corona Virus.
By law, the government can enact regulations restricting stay in public space "if it is convinced that this is necessary to prevent and infect corona virus among the public and reduce its spread, reduce morbidity or protect at-risk populations, ; Violation of rights; And the effects on the economy. '
According to the petitioners, when it comes to flights to green countries, the ban on flying outside Israel during the closure period is not required to prevent infection and spread of the virus. "It is more problematic to stay in the country, despite all the restrictions imposed during the closure period, than to stay in a green country," the petitioners write. "The ban is also not to the extent necessary. It was possible to ban the opening of additional flights during the closure period, but to allow the departure of departing flights, which should also return passengers departing and wanting to return to Israel.
Israir also notes the violation of the Basic Law: Freedom of Occupation, which requires that the violation be for a proper purpose. "The ban on purchasing tickets, in contrast to the ban on adding outbound flights during the closure period, harms Israir to an extent that exceeds what is required," the petitioners write.
