A confrontation between Israel's domestic intelligence agency, the police and the attorney general has intensified amid allegations of foreign interference in the country's parliamentary elections, raising concerns about the independence of law enforcement and the integrity of the democratic process.

Shin Bet Director David Zini has reportedly refused to transfer intelligence materials concerning suspected foreign financing of Arab political parties to a joint investigative team, despite an agreement reached during a meeting chaired by Supreme Court Justice Noam Sohlberg, the head of the Central Elections Committee.

According to a report by Haaretz, citing senior law enforcement sources, Zini has demanded criminal investigations of prominent Arab political figures, including Ra'am leader Mansour Abbas, Ahmad Tibi and Balad chairman Sami Abu Shehadeh, despite the reported absence of substantiated evidence against them.

The intelligence chief has also reportedly sought an investigation into another lawmaker allegedly linked to the receipt of hundreds of thousands of shekels.

The allegations have triggered an unusually public dispute between Israel's intelligence establishment and its senior legal authorities, with both sides accusing the other of undermining the investigation.

Attorney General Accuses Shin Bet of Delaying Investigation

Attorney General Gali Baharav-Miara publicly confirmed that the Shin Bet had not transferred the relevant investigative materials to the special team established following Sohlberg's recommendation.

According to her statement, the agency's failure to provide the information for two days had effectively delayed the investigation.

The joint team, comprising Shin Bet and police investigators under prosecutorial supervision, was intended to evaluate the intelligence and determine whether sufficient evidence existed to justify criminal proceedings.

Baharav-Miara stressed that Israeli law does not permit the investigation of citizens or elected representatives without an adequate evidentiary basis.

She also rejected allegations that her office was obstructing the investigation, saying significant investigative measures requested by the Shin Bet had already been authorized.

"Anyone who needs to be investigated will be investigated," she declared.

Allegations of Foreign Money and Voter Payments

At the center of the dispute are allegations that an unidentified foreign actor financed activities intended to influence voting within Israel's Arab community.

According to the reported intelligence claims, funds were allegedly used to purchase fuel vouchers and distribute cash to voters in an effort to increase support for the Joint List and Ra'am.

If substantiated, such conduct could raise serious questions involving election bribery, unlawful political financing and potential foreign interference in Israel's electoral process.

However, law enforcement sources cited by Haaretz questioned the reliability of the information presented by Zini, claiming that some allegations rested on unverified testimony and social media images rather than independently corroborated evidence.

The report also alleged that Zini sought to classify the suspected conduct as a national security matter, potentially enabling the use of exceptional investigative powers, including restrictions on suspects' access to legal counsel.

Such measures would require a specific legal basis and could not automatically be justified by allegations of election-related misconduct.

The report further claimed that Zini had attempted to communicate directly with Sohlberg while bypassing the attorney general, a characterization that remains disputed.

Election Commission Chairman Rejects Any Delay in Results

Despite the controversy, Sohlberg has made clear that the publication of the election results must proceed as scheduled.

In a message to members of the Central Elections Committee, he emphasized that no individual or political faction has the authority to prevent the official publication of the results because of unproven allegations.

Any challenge to the validity of the election, he explained, must be addressed through the courts after the results are published.

His intervention draws a distinction between investigating potential criminal wrongdoing and interrupting the constitutional process through which election results are certified and a newly elected Knesset assumes office.

Netanyahu's Likud Accuses Attorney General of Cover-Up

Prime Minister Benjamin Netanyahu's Likud party sharply criticized Baharav-Miara, accusing her of preventing essential investigative measures and attempting to conceal a potentially serious national security offense.

Likud described the reported developments as an earthquake for Israeli democracy and accused the attorney general of blocking investigations involving Arab political leaders and another unnamed lawmaker.

The party also alleged that the attorney general had improperly extended parliamentary immunity protections to parliamentary aides.

Baharav-Miara rejected the accusations, insisting that prosecutors had approved significant investigative steps and that all further measures must comply with established legal requirements.

The competing claims reflect a broader struggle over the authority to direct sensitive investigations involving political figures during a period of acute electoral uncertainty.

Opposition Leaders Warn of Threat to Democracy

Opposition leaders responded with accusations that the controversy represented an attempt to interfere with the democratic transfer of power.

Gadi Eisenkot, chairman of the Yashar party, warned against using state institutions for partisan objectives, emphasizing that security and law enforcement officials serve the state rather than individual political leaders.

He accused Netanyahu and Likud of pushing Israel toward a dangerous constitutional crisis.

Opposition leader Yair Lapid went further, alleging that the controversy reflected an attempt to undermine the election outcome with the assistance of politically aligned officials within the security establishment.

These allegations remain political claims and have not been established by an independent judicial finding.

The Larger Question: National Security or Political Interference?

The dispute raises fundamental questions about the boundaries between intelligence gathering, criminal investigation and political authority in Israel.

The Shin Bet has a legitimate responsibility to identify threats arising from hostile foreign interference, including covert attempts to manipulate democratic elections. At the same time, intelligence assessments do not automatically constitute admissible criminal evidence, and investigative powers remain subject to judicial and prosecutorial oversight.

Foreign financing of electoral activity, if proven, could constitute a serious attack on electoral integrity. Equally, the use of extraordinary security powers against elected representatives without adequate evidence could undermine civil liberties and democratic accountability.

The immediate legal question is whether the intelligence gathered by the Shin Bet establishes a credible basis for criminal investigation and whether the agency must share the relevant material with the authorities responsible for conducting it.

The political stakes extend beyond the allegations themselves. The controversy has become a test of whether Israel's security institutions, prosecutors and electoral authorities can resolve a sensitive investigation without compromising the legitimacy of the election.

For now, Sohlberg's position is unequivocal: the election results must be published, and any allegations of wrongdoing must be examined through the legal process rather than used to suspend it.
