The hearing of the evidence in the Alpine cases in which Prime Minister Benjamin Netanyahu is accused of bribery, fraud and breach of trust will begin on Monday, April 5, 2021, that is, after the election. The three judges stressed that they do not accept the request in a way that justifies the dismissal of the entire indictment, but left an opening for a discussion of Netanyahu's allegations after the evidentiary stage.
"After reviewing the counsel's memorandum of January 5, 2021," they wrote, "on its appendices, as well as in the documents relevant to the alleged consent, we were not persuaded to accede to the application due to the procedural defect in the defendant in the absence of written counsel's open confirmation A clear reason was found to substantiate the claim for the dismissal of the indictment, and at least, for the disqualification of evidence, at the preliminary stage of the hearing. "
"However," the judges continued, "at the conclusion of the proceedings we will consider whether there is justification in the circumstances of the case to disqualify due to the lack of admissibility of evidence in cases 1000 and 4000, insofar as it is determined that investigative actions were taken prior to counsel."
The judges ruled: "Moreover, even with regard to the disqualification of evidence due to the alleged execution of investigative actions, before granting approval for their execution, we were not convinced that the request, the body, the preliminary stage of the hearing and findings in the case must be determined before the evidence is heard. The defendant's claim regarding the performance of some of the investigative actions without the counsel of the counsel, including orally, and the issues that arise from it regarding the evidence obtained from these actions, must be clarified in the melting pot of the criminal proceedings and after hearing the evidence. "
However, at the end of the proceedings, we will consider whether there is justification in the circumstances of the case, insofar as it is determined that investigative actions were carried out 4000 - and 1000 to disqualify, due to lack of admissibility, evidence in cases before giving counsel
The judges criticized the Attorney General and the State Attorney's Office for granting permission to open an oral investigation only and not in writing. "In the circumstances in which the counsel's consent was given, in so far as it was given," it read, "by way of documenting the authorization to open an investigation into the defendant's case, moving to its opening, not by way of written approval, there was a defect in the counsel's conduct."
The panel of judges ruled that the hearings would take place three days a week, on Mondays, Tuesdays and Wednesdays, from 9:00 to 15:30. There will be no meeting on Memorial Day for the victims of the Israeli military and the victims of hostilities, which took place on April 14th.
