A class action lawsuit has been filed and approved against the Phoenix insurance company for health insurance policies issued by 2016. The scope of the claim is estimated to be NIS 125 million.
This is a class action request that was filed in June 2015 and dealt with how the insurance company used to compensate policyholders who used the supplemental insurance of their health insurance fund rather than private insurance. The period during which the claim is concerned is June 2012 to June 2015.
By 2016, private health insurance policies included a mechanism that would incentivize policyholders in double insurance to claim health insurance coverage and receive compensation - the amount of money if the insured would use the coverage already in the possession of the supplementary insurance rather than that of private insurance.

Prosecutors claim that the Health Ministry's tariff only serves as a tool in the relationship between the health funds and the hospitals, and there is no need for surgery in a private hospital. The question that arose from the lawsuit is what the proper interpretation of Phoenix's health insurance policies is in relation to the value of Form 17 where the insurance company did not actually fund the analysis, but as stated, only compensates the insured for operating the insurance fund
