The National Labor Court rejected Friday's state demand to issue restraining orders - announcing that the 10th grade school year is over. Meaning: Upon accepting the Teachers Organization position, the middle school year is over, and kindergarten and elementary students left for the Great Holidays on July 1st.
"We do not express any position on the implications of this decision on the obligation of the Teachers' Union to act in accordance with its agreements with the state," the judges wrote. "In the absence of a normative source to require the extension of the school year to the 10th grade, in accordance with the outline of the Teachers' Union, the Tribunal does not have the right to grant the requested relief, only because of the possible consequences that can be resolved in other ways."
The Ministry of Education said that "following the decision of the National Labor Court, Education Minister Yoav Galant contacted the Secretary-General for Teachers' Federation and agreed with her on the operation of the Great Freedom School for kindergarten and fourth-graders from July 1 to August 6" The ministry noted that teaching staff could work in the framework in exchange for additional pay.
"The School of Great Freedom will allow students to complete gaps created in the past year due to the Corona eruption, returning to a supplementary education setting during this challenging period will also enable stability for the Israeli economy and will help the country financially and socially," the ministry statement said.
The teachers 'union announced that "according to the court's ruling, only the teachers' union is allowed to instruct middle school teachers on how to act. The agreement signed enshrined the full pay of all civil service teaching staff and established the principle of equality among all teaching staff in the education system."
Previously, state representatives have sought to postpone the end of the school year. "Proposals were made in the spirit of the outline and in accordance with the comments of the national court," state representatives wrote. "The teachers' organization raised disproportionate demands that do not clash with the crisis, economic and contractual realities, and thus failed to reach the applicants."
The teachers' organization responded to the allegations, claiming that the teachers had been volunteering for 27 days. "Beyond the fact that there was no pedagogical point in the need to attend 10th grade and in the absence of any normative source - there is no reason to add on these assignments that are in any case performed by the teacher public out of a sense of mission," the lawyers for the organization wrote. "The only reason the state seeks to force teaching staff in secondary education to work for another nine days is baseless and legal or moral justification," they added.
The Labor Court was to decide today at 4pm whether to comply with the state's request and issue restraining orders against the teachers' organization after the parties failed to reach consensus. The state sought to postpone the decision Saturday night, although Judge Leah Glicksman yesterday made it clear to the parties that it does not intend to hold another hearing.
It was also noted that the teachers 'organization filed its response about an hour and a half before the hearing last night, and state-level petitioners demanding restraining orders argued that they were not given enough time to prepare for the teachers' arguments. "The issues facing the national tribunal go toward public and economic aspects that cannot be overstated in their meaning and economic implications," the state requests that each of the parties who ask it be allowed to submit a plea to the tribunal on its behalf, until Saturday night at 21:30.
